1. AI Policy
Last updated: <date>
1 Purpose
Welcome to Find House (the Platform), operated by the entity identified in the Operator Details at the beginning of these documents (Find House, we, us). This AI Policy applies to AI features actually made available on the Platform. It forms part of the Terms and Conditions when accepted under clause 1 of those Terms. The Privacy Policy explains personal information handling; accepting contractual terms is not a separate consent to optional AI training or marketing. The protections in clauses 16 and 17 of the Terms and Conditions apply to this Policy.
2 Scope of AI Features
The Platform may provide property search, matching, recommendations, enquiry assistance, content generation and market information tools. Available AI features, their purpose and any applicable charges will be identified before use. Availability may vary by service or location. Changes, suspension and the introduction of fees are subject to clauses 4, 13, 15 and 21 of the Terms and Conditions. We will not automatically enrol a user in a paid AI service without the user's agreement.
3 AI Is Not a Professional Adviser
The user acknowledges that the Platform's AI systems are tools for information organisation, search, content generation and assistance. They are not licensed professionals and must not be used to provide a service for which a real estate, legal, financial services, credit or other professional authorisation is required. We do not authorise AI to negotiate a property transaction, accept an offer or enter into a contract on anyone's behalf. Users should obtain appropriately qualified advice for property, legal, financial, mortgage, tax and investment decisions. This description does not exclude our obligations arising from services we actually provide.
4 AI Content for Reference Only
AI responses, suggestions, rankings, summaries, matching results and market analyses are general information. Any automated price estimate is not a formal valuation or a promise of a sale price or return. Users should check material facts against current source documents, the listing agent and independent professional advice. We remain responsible for our own representations and for any obligations that cannot lawfully be excluded; these cautions do not make the user responsible for every loss.
5 Potential AI Errors
AI may produce inaccurate, incomplete, biased or outdated information, including invented facts, incorrect matches and errors in analysis. We do not promise that every AI output will be correct. We will take reasonable steps appropriate to the feature to assess its suitability, monitor material errors and address reported problems. Users must not rely solely on AI when making a material property, financial or legal decision. Please report a suspected error using the support contact in the Operator Details. Nothing in this clause limits applicable consumer guarantees.
6 AI Recommendations and Rankings
Recommendations, search results, featured listings and rankings may reflect the user's search criteria, available listing data, recency, relevance and commercial arrangements. The relevant feature will explain the main factors affecting its results. Paid placements and material commercial influences will be clearly identified where displayed. Results cover the listings and agents available to the Platform and do not necessarily represent the whole market. A ranking is not a guarantee of suitability, authenticity, investment value or transaction success. We will not present paid promotion as an independent assessment.
7 Third Party AI Technology
We may use third-party AI providers identified in our Privacy Policy or the notice for the relevant feature. We will take reasonable steps to assess those providers and put appropriate contractual and technical controls in place. Only information reasonably necessary for the disclosed service may be sent to them. Ordinary use of an AI feature does not authorise us or our providers to train general-purpose models on identifiable enquiries or private communications. Optional training requires the separate process in clause 6 of the Privacy Policy. Using a third-party provider does not remove our own legal responsibilities.
8 AI Communication Disclaimer
AI chats, automated messages, voice assistants and digital characters will be identified as automated when users interact with them. They must not impersonate a licensed professional or claim authority to bind a transaction party. Users may request human support through the support contact. Before a call is recorded or transcribed, we will explain the purpose, use and retention of the recording and obtain the consent required by applicable recording and privacy laws. Users should not provide identity documents, payment credentials or sensitive personal information through a general AI chat.
9 Limitation of Liability
Our responsibility for AI features is governed by clauses 16 and 17 of the Terms and Conditions. No AI disclaimer excludes Australian Consumer Law rights, our responsibility for misleading conduct, or privacy obligations that cannot lawfully be excluded.
10 Policy Amendments
Changes to this AI Policy are subject to clause 21 of the Terms and Conditions. Changes to personal information handling are also subject to clause 16 of the Privacy Policy. A policy update does not retrospectively authorise new uses of information.
2. Terms of Service
Last updated: <date>
1 Acceptance of Terms
These Terms and Conditions are between the user and the operator identified in the Operator Details. They govern Australian use of the Platform. A user accepts them by selecting an agreement checkbox or taking another clearly identified acceptance step after being given access to the Terms, including when registering, purchasing a service, listing property or joining a referral program. Mere browsing does not, by itself, constitute acceptance of payment obligations, an indemnity or optional data uses. Registered users must be at least 18 and have authority to act for any business they represent. The AI Policy and, where relevant, Agent Listing Agreement and Referral Program Agreement form part of the contract. The Platform Status Declaration explains the service boundaries. The Privacy and Cookie Policies explain information handling and are not blanket consent forms. Mandatory law prevails. A more specific service term prevails over a general term only to the extent of an actual inconsistency; no service term or order overrides clauses 16 and 17 or applicable privacy rights. An expressly agreed written order records the particular service, fees and term. Before acceptance, we will take reasonable steps to draw attention to terms that may substantially prejudice the consumer, including relevant limits on liability, cancellation conditions and unusual data-sharing arrangements, where required by applicable law. Material financial incentives for a referral will be disclosed before the relevant referral or supply arrangement is made.
2 Nature of Platform and Status
Find House provides property information display, search, matching, enquiry transmission and technical tools. Under these Terms it does not act as a buyer's, seller's or leasing agent; negotiate property transactions; accept or communicate binding offers as a party's representative; or hold purchase deposits, rent, bonds or other client money. Property transactions are contracted separately between the relevant parties. Platform service fees are distinct from transaction money. The legal character of an activity depends on what is actually done. These Terms do not permit an activity requiring a licence, authorisation or regulated arrangement without those requirements being met. Our own service obligations and responsibility for our conduct remain. Any expansion into transaction representation, commission-based brokering, credit assistance or handling client money requires separate compliant arrangements before that activity is offered.
3 Account Responsibility
The user must provide accurate account information, keep it up to date, take reasonable steps to protect login credentials and notify us promptly of suspected unauthorised access. Business account administrators are responsible for appropriately authorising their users. The user is responsible for activity they authorise and loss caused by their failure to take reasonable care, to the extent of that contribution. They are not automatically responsible for every act through a compromised account. We will take reasonable steps to secure the Platform and investigate reported unauthorised use.
4 Platform Rights
We may take reasonable and proportionate action to protect security, prevent fraud or unlawful conduct, address a material breach, comply with law, or maintain the Platform. This may include rejecting a listing, correcting a category, restricting a feature or suspending an account. Except where urgency, law or a serious risk requires otherwise, we will give the affected user the reason and a reasonable opportunity to respond or remedy the issue. We will explain urgent action as soon as reasonably practicable and provide a review through our support contact.Termination for convenience requires at least 30 days' notice. Changes to paid services and pricing must follow clauses 15 and 21. We will provide reasonable access to retrieve the user's content, unless prohibited by law or necessary to prevent harm, and refund prepaid fees for services not supplied, subject only to reasonable amounts lawfully due for services already supplied. Accrued statutory rights are unaffected.
5 Property Data and Content Disclaimer
Property information, images, prices, areas and agent details are generally supplied by third parties. We do not independently inspect every property or verify every statement. Users should check current availability, title, approvals, dimensions, price and suitability with the relevant agent and advisers. We will take reasonable steps to address credible reports of unlawful or misleading content, and correct or remove affected material where appropriate. We remain responsible for content and representations we create, adopt or materially alter and for duties imposed by law. No verification badge may suggest checks beyond those actually completed.
6 Recommendations and paid placements
Search and recommendation features help users navigate available information. We will identify sponsored placements and disclose material paid influences on matching, rankings or referrals where relevant. Results are not a whole-of-market comparison unless expressly stated and substantiated. A displayed ranking is not a guarantee of quality, suitability or returns. The AI Policy also applies. We remain responsible for representations made about the independence, methodology or performance of these features.
7 No Guarantee of Commercial Outcomes
Find House does not promise a particular number of enquiries, viewings, transactions, sales, leases or investment returns, or a particular advertising or search ranking outcome, unless expressly included in the agreed service description. This does not excuse us from supplying a paid service as described or from meeting applicable consumer guarantees. Statements about leads, exposure and performance must have a reasonable basis.
8 User content
Users are responsible for having the authority to submit their content and for ensuring it is lawful and not misleading, discriminatory, defamatory or infringing. Reviews must reflect genuine experience; incentives and material relationships must be disclosed. We may moderate content under clause 4 and will provide a way to report harmful or infringing content. Responsibility for user content is allocated according to applicable law and each party's conduct, rather than transferred entirely to the user.
9 Content licence and permitted uses
Users retain their intellectual property rights. They grant Find House a non-exclusive, royalty-free licence to host, copy, format, display and distribute submitted listing and profile content only as reasonably necessary to provide the requested services and promote that listing or profile through the channels disclosed when it is submitted. The licence may be sublicensed to service providers only for those purposes. It does not permit unrelated endorsements, the sale of private communications or unrestricted AI training. The licence ends when the content is removed or the account ends, except for a reasonable period to complete removal from distribution channels and backups, and limited retention required by law, security or an existing dispute. Retained copies must not remain in active advertising. Personal information remains subject to the Privacy Policy and applicable law. Separate, specific authority is required for optional model training and any use outside this licence. Aggregated information may be used only where individuals cannot reasonably be identified and the use does not infringe third-party rights.
10 Prohibited Conduct
The user must not publish false or unlawful information, impersonate others, infringe rights, harass or unlawfully discriminate, interfere with systems, introduce malware, access accounts without authority, manipulate rankings, or collect personal information without a lawful basis. Automation must comply with clause 11. We may take proportionate action under clause 4; a complaint or honest negative review is not itself prohibited conduct.
11 Scraping and System Protection
Without our written permission, users must not scrape, crawl, extract or copy protected Platform databases or use automated access in a manner that infringes rights, compromises security, collects personal information unlawfully or materially disrupts the service. This clause does not restrict activity permitted by mandatory law, a right to retrieve one's own data, or use expressly permitted through a published interface. Security concerns may be reported to our support contact.
12 Intellectual Property
Find House and its licensors retain rights in their software, branding, designs and original Platform content. Users receive a limited right to access those materials for permitted Platform use. User-owned materials remain governed by clause 9. We do not claim ownership of third-party materials or exclusive rights in an AI output merely because it was generated on the Platform. Users should check any third-party rights before using generated material commercially.
13 Service Interruption
We may temporarily interrupt a service for maintenance, upgrades or security work. We will give reasonable advance notice of planned material interruptions where practicable, take reasonable steps to minimise disruption and restore the service promptly. Interruptions do not remove applicable remedies for a failure to supply a paid service. If a material interruption continues for more than 14 consecutive days, the user may cancel the affected service and receive a proportionate refund for the unused prepaid period, without limiting any earlier statutory remedy.
14 Force Majeure
Neither party is responsible for delay caused by an event genuinely beyond its reasonable control, to the extent that reasonable precautions could not have prevented the delay. The affected party must notify the other where practicable and take reasonable steps to reduce the effect. An ordinary supplier failure, lack of funds or inadequate security is not automatically such an event. Payment is not due for services not supplied. Either party may cancel an affected service after 14 consecutive days of material inability to perform, with a proportionate refund of unused prepaid fees. Clauses 16 and 17 continue to apply.
15 Fees and Refunds
Before a user purchases a service, we will disclose its scope, duration, total price in Australian dollars, GST treatment, compulsory charges, billing frequency and cancellation terms. No fee is payable merely for browsing. An order must identify any automatic renewal and obtain the user's express agreement. We will give reasonable advance notice of renewal and its price, ordinarily at least 14 days for annual or other long-term plans; the checkout must explain the cycle for a shorter recurring plan. Users may turn off renewal through the account or support contact using a reasonably straightforward process.Cancellation of renewal takes effect at the end of the current paid period. We do not charge for a further period after an effective cancellation. Change-of-mind refunds for a service properly supplied are available only if included in the disclosed offer or otherwise agreed. This does not limit refunds, cancellation, compensation or other remedies required by the Australian Consumer Law or these Terms. If we cancel or materially reduce an uncompleted service, or a user exercises a cancellation right under clause 21, we will refund the unused prepaid portion and any further amount required by law. We will not impose undisclosed cancellation charges or retrospectively increase an agreed fixed-term price.
16 Consumer rights and liability
Nothing in these documents excludes, restricts or modifies any consumer guarantee, remedy or other right or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). This protection applies to eligible business customers as well as individual consumers. Services must meet applicable guarantees, including due care and skill and applicable fitness and timing requirements.Where a service has a major failure, the consumer may cancel it and obtain a refund for the unused portion or compensation for its reduced value, together with compensation for reasonably foreseeable loss as provided by law. For a remediable non-major failure, the supplier must remedy it within a reasonable time; further remedies apply if it does not. Clause 17 applies only in the limited circumstances stated there.Subject to clause 17, responsibility for loss is determined by applicable law, including causation, reasonable foreseeability and each party's contribution. We do not accept responsibility for a third-party transaction merely because it was advertised on the Platform, but remain responsible for our own breach, negligence and misleading conduct. No general exclusion of direct loss, all data loss or all third-party service failures applies.
17 Limited remedies for qualifying business services
Only where services are not of a kind ordinarily acquired for personal, domestic or household use, and section 64A of the Australian Consumer Law permits it, liability for failure to comply with a consumer guarantee is limited, at our option, to supplying the services again or paying the reasonable cost of having them supplied again. This limitation does not apply if it would not be fair or reasonable for us to rely on it. It does not limit liability for misleading conduct, privacy breaches, fraud, wilful misconduct or any liability to which section 64A does not apply. These standard Terms do not impose a fixed monetary cap on other liability. Any additional business liability cap must be separately and expressly agreed in writing, fairly allocate the relevant risk and comply with applicable law, including unfair contract terms protections. It cannot override clause 16 or the limits of this clause.
18 Limited business indemnity
A user acting in the course of a business indemnifies Find House only for reasonable loss and third-party claims to the extent caused by that user's material breach of these Terms, negligence, wilful misconduct or infringement of third-party rights. No indemnity applies to loss caused or contributed to by Find House or its personnel, loss that could reasonably have been avoided, or a fine or penalty that cannot lawfully be indemnified. It does not apply merely because a complaint or regulatory investigation occurs.Find House must give prompt notice of the claim, take reasonable steps to mitigate loss, allow the user reasonable participation in the defence and not agree a settlement affecting the user without their consent, not to be unreasonably withheld. Recoverable legal costs must be reasonable. There must be no double recovery. This indemnity does not apply to users acting solely for personal, domestic or household purposes and remains subject to clauses 16 and 17.
19 Complaints governing law and disputes
A party may notify the other of a dispute using the contact details provided. We will acknowledge a complaint within 5 business days and aim to provide a substantive response within 30 calendar days. The parties should try in good faith to resolve it; mediation is voluntary unless separately agreed. This process is not a condition that prevents court or tribunal proceedings, an urgent application, preserving a limitation period or contacting a regulator. These Terms are governed by the laws of the Governing State identified in the Operator Details and applicable Commonwealth law. Mandatory laws of another relevant Australian State or Territory continue to apply. The parties submit to the non-exclusive jurisdiction of competent Australian courts and tribunals. A consumer may use a competent court or tribunal available in their State or Territory of residence. There is no compulsory overseas arbitration requirement.
20 Representative proceedings
These Terms do not waive or restrict a user's right to participate in a class or representative action, make a regulatory complaint or exercise any other right that cannot lawfully be excluded.
21 Amendments
We may make changes reasonably necessary to reflect changes in law, security, technology or the services we provide. For a material change that adversely affects an existing user's rights, charges or paid service, we will give at least 30 days' advance notice by email or another effective account notification, explain the change and allow cancellation before it takes effect without an additional charge, with a proportionate refund of unused prepaid fees. We will not retrospectively remove accrued rights or increase an agreed fixed-term price without agreement. An earlier change is permitted only to the extent reasonably necessary to meet a legal requirement or address an urgent security risk; we will give as much notice as practicable and preserve applicable cancellation and refund rights. A change that requires consent will not take effect for that user without consent. A material expansion of personal information use must also comply with the Privacy Policy; continued use alone is not consent to optional marketing or AI training.
22 General provisions
Electronic notices must be sent to the current contact details supplied and are subject to applicable law; an unsuccessful delivery is not automatically effective notice. A party may not assign this contract without the other party's consent, not to be unreasonably withheld, except where the law permits otherwise. An assignment must not reduce consumer rights. If a provision is invalid, it is severed only to the extent necessary and the remaining provisions continue if they can operate lawfully. A failure to exercise a right immediately is not a waiver. No provision shortens a statutory limitation period. These documents do not create an employment, partnership or agency relationship between Find House and a user. Accrued rights and provisions necessary to resolve an existing claim survive termination only to the extent appropriate and lawful.
3. Agent Listing Agreement
Last updated: <date>
1 Application
This Agreement applies to businesses and authorised persons listing or managing property or receiving enquiries through Find House. It is accepted by a clearly identified agreement step after the person has access to this Agreement and the Terms and Conditions. An employee must have authority to bind the relevant agency or other business, which must be identified on the account and order. The Terms and Conditions govern fees, changes, suspension, remedies and disputes. This Agreement does not appoint Find House as an estate agent or confer any authority to conduct licensed work.
2 Agent Status and Licensing
The agent represents that the agent and the relevant agency hold all licences, registrations, authorisations and supervision arrangements required for the activities and locations in which they operate, or have a lawful exemption applicable to their own activities. A licence in one State or Territory must not be represented as authority to work elsewhere unless the applicable recognition requirements are met. Required licence and business details must be displayed. The agent must notify us promptly of expiry, suspension, restrictions or loss of authority. We may request evidence and carry out reasonable checks; our checks do not replace the agent's obligations or constitute a guarantee of professional suitability.
3 Owner Authorisation
The agent must hold valid written authority to advertise each property, comply with any applicable agency agreement and obtain required consents from the owner or other rights holder. Authority must cover the publication channels and material supplied. The agent must provide reasonable supporting evidence on request and remove or update a listing when authority ends. We may restrict a listing pending verification under clause 4 of the Terms and Conditions.
4 Property Data Responsibility
The agent must ensure listing information is accurate, current and lawful, including price or rent, availability, address, area, floor plan, photographs, features, charges and material disclosures. Required sale documentation and authority must be in place before advertising where the applicable law requires this. Prices and estimates must comply with local underquoting, pricing and rental advertising requirements. The agent must promptly correct changes, including a sale, letting, withdrawal or revised price, and keep evidence supporting material claims.
5 False Listings and Misleading Content
The agent must not publish fictitious or unauthorised listings, bait prices, misleading availability, fabricated sales results or unsubstantiated promotional claims. Historical sold or leased records must be clearly labelled and lawfully published. We may urgently restrict content where there are reasonable grounds to suspect unlawful or materially misleading content, followed by the notice and review process in clause 4 of the Terms and Conditions.
6 Images, Videos and Copyright
The agent must have the rights and permissions needed to use submitted images, videos, floor plans, logos and text and grant the licence in clause 10. Material alterations, virtual staging and artist's impressions must be clearly identified and must not misrepresent the property's condition, outlook, dimensions or surroundings. Photographs and recordings must respect occupants' privacy and applicable surveillance laws. No person may create or publish an unauthorised likeness or voice imitation. Liability depends on each party's conduct and the Terms and Conditions.
7 Advertising Content Responsibility
The agent is responsible for the advertising content they supply and must not publish false, misleading, fraudulent, discriminatory, defamatory or infringing material. The agent must meet local advertising, disclosure, price and rental rules and must not use the Platform for prohibited rent bidding, prohibited tenant charges or unlawful selection practices. Find House remains responsible for its own content and alterations. Paid promotion, incentives and material relationships must be transparently disclosed.
8 Use of Customer Data
Customer information may be used only to respond to the particular enquiry or provide a service the individual requested or separately authorised. It must not be sold, shared with unrelated recipients, added to unrelated marketing lists or used for harassment. The agent must protect it, restrict access, comply with the Privacy Act 1988 (Cth) where applicable and applicable marketing and recording laws, and follow the individual's lawful preferences. Each party remains responsible for its own handling. The agent must notify Find House without undue delay, and in any event within 24 hours of becoming aware of a suspected material unauthorised disclosure affecting Platform enquiry data, and cooperate on investigation, containment and legally required notifications.
9 Enquiry allocation and privacy
An enquiry is information about an individual, not property owned by the Platform or agent. An individual's directions about recipients and contact must be respected. Enquiries are non-exclusive unless the order expressly states otherwise. Allocation must follow the disclosed service description, permissions and matching rules. We may change future allocation reasonably under the Terms and Conditions but must not defeat an agreed paid entitlement or redistribute information beyond the notified purpose or consent. No transaction outcome is guaranteed.
10 Limited content licence
The content licence in clause 9 of the Terms and Conditions applies to the agent's submitted listing and profile materials. It is limited by purpose and duration and survives removal only to the extent stated there. The agent must hold the rights necessary to grant it. Personal information, third-party photographs and communications are not subject to an unrestricted perpetual licence.
11 Separate authority for AI training
Using submitted information to deliver an authorised AI search or matching service is distinct from training or fine-tuning a model. Ordinary listing and account acceptance does not authorise optional AI training. Any training use requires a separate, specific agreement and any necessary consent of affected individuals and other rights holders, as described in clause 6 of the Privacy Policy. An agent cannot waive the rights of an owner, photographer, occupant or customer without authority.
12 Platform Management Rights
Our management of listings and accounts is subject to the reasons, proportionality, notice, remedy and review safeguards in clause 4 of the Terms and Conditions. We must respect agreed paid service commitments and provide any applicable refund or other remedy.
13 No Guarantee of Transaction
No particular enquiry volume, viewing, sale, lease, investment return or business growth is guaranteed unless it is an express part of the agreed service. This does not limit the obligation to deliver agreed advertising or subscription services or applicable consumer guarantees.
14 Anti Money Laundering and Unlawful Use
The agent must not use the Platform for money laundering, terrorism financing, sanctions evasion, fraud or sham transactions. The agent must determine and meet any obligations applying to its own designated services under Australian AML/CTF law, including enrolment, risk assessment, customer due diligence, record keeping and reporting where required. We remain responsible for any obligations applying to our own activities. We may restrict an account and preserve relevant records where reasonably necessary, and disclose information where lawfully permitted or required. A notice may be withheld where the law prohibits it. No deposit, rent, bond or other client money may be paid to Find House under this Agreement.
15 Indemnity
The limited business-user indemnity in clause 18 of the Terms and Conditions applies. It does not transfer Find House's own negligence, breach, misconduct or non-indemnifiable fines to the agent, and does not arise merely from a complaint or investigation.
16 Limitation of Liability
Clauses 16 and 17 of the Terms and Conditions govern liability. The agent's business status does not itself exclude Australian Consumer Law guarantees or the protections against unfair terms in eligible small business contracts.
17 Amendments
Amendments are subject to clause 21 of the Terms and Conditions, including notice, cancellation and refund rights. Accrued rights and an agreed fixed-term price must not be retrospectively changed.
4. Platform Status Declaration
Last updated: <date>
1 Purpose
This Declaration explains the services Find House offers under the Terms and Conditions and their boundaries. It should be read with the service description and the applicable agreements. It does not determine the legal character of conduct by a label, create a blanket waiver, or override consumer, licensing, privacy or other mandatory law.
2 Platform Status
Find House provides property information display, search, matching, enquiry transmission and technical tools, including the AI features actually offered. It supplies those Platform services and is responsible for its own contractual and statutory obligations. The transactions advertised and services offered by listing agents are separate from the Platform services.
3 No Real Estate Agency Status
The services covered by these documents do not include acting as a buyer's, seller's or leasing agent or otherwise representing a transaction party. Find House must not undertake activities requiring an estate agent licence or other authorisation unless it has satisfied the applicable State or Territory requirements and the relevant customer has separately agreed to the regulated service. Calling a service a technology service does not avoid those requirements.
4 No Intermediary Status
Find House may transmit a user's contact enquiry to a disclosed recipient. It does not under these documents negotiate terms, advise a party what offer to make, communicate or accept a binding offer as a representative, sign transaction documents, or hold client money. Users must give offers, notices and instructions directly to the appropriately authorised person. A contact enquiry or automated acknowledgement is not an acceptance of an offer or a concluded property contract.
5 No Transaction Party Status
Find House is not the buyer, seller, landlord, tenant or guarantor of a property transaction merely because it appears on the Platform. Any sale, lease or related professional engagement is between the relevant parties. This does not affect our separate role as the supplier of Platform services or our responsibility for representations we make.
6 No Investment Adviser Status
Find House does not offer financial product advice or investment management under these documents. General market information and automated estimates do not promise investment suitability, returns or capital growth. Any activity involving financial products, managed investments or another regulated financial service requires the applicable authorisation and separate arrangements. A disclaimer does not authorise unlicensed advice.
7 No Mortgage Adviser Status
Find House does not offer credit assistance, act as a mortgage broker, assess loan suitability or promise finance approval under these documents. Any referral to a finance provider must satisfy applicable credit licensing or exemption requirements and disclose relevant benefits before it is made. A referral does not authorise the Platform to recommend a particular credit contract or handle an application as a representative.
8 No Legal Adviser Status
Find House does not provide legal representation or legal advice through the Platform services covered by these documents. Users should obtain advice from a qualified lawyer about contracts, title, legal rights, foreign investment requirements and other relevant legal questions. An AI-generated explanation is not a solicitor-client engagement.
9 Recommendations and paid placements
Search and recommendation tools assist navigation. The main ranking factors and material commercial influences will be explained for the relevant feature, with sponsored results clearly identified. These features do not guarantee suitability or investment value. Clause 6 of the AI Policy and clause 6 of the Terms and Conditions apply; the Platform does not deny responsibility for recommendations or representations it actually makes.
10 No Guarantee of Property Authenticity
Third-party property information is not independently verified in every case. Users should make appropriate independent enquiries. We will not imply that authenticity, title or agent suitability has been verified unless the stated checks have actually been performed, and we will act reasonably on credible reports of misleading or unlawful content. Clause 5 of the Terms and Conditions applies.
11 AI Function Statement
AI features are automated, may make mistakes and must be used consistently with the AI Policy. They do not replace independent checks, professional advice or any required human decision. We will clearly identify automated interactions and provide a contact for human support.
12 Transaction Responsibility
The transaction parties are responsible for performing their own sale, lease, financing and professional agreements. Find House does not adjudicate those agreements, but will deal with complaints about its own services, provide reasonable cooperation where appropriate and comply with lawful information requests. Users retain access to regulators, courts and tribunals.
13 Limitation of Liability
Clauses 16 and 17 of the Terms and Conditions govern the Platform's liability. This Declaration does not exclude responsibility for our own conduct or any non-excludable legal obligation.
14 Final Confirmation
The roles described here must match actual Platform activities. Before changing the service scope, Find House must meet additional legal requirements and provide appropriate terms and disclosures.
5. Privacy Policy
Last updated: <date>
1 Purpose
Find House is operated by the entity named in the Operator Details. This Privacy Policy explains how we collect, hold, use and disclose personal information and how to contact us about access, correction or a complaint. We apply the practices described here and comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles to the extent they apply to us. This Policy is a notice about our practices; viewing it or using the Platform is not blanket consent to every possible use of information. Where consent is required or an optional use is offered, we will seek it separately.
2 Scope
This Policy covers people who browse, register, list property, make an enquiry or referral, use AI features or otherwise deal with Find House. When a user asks us to pass information to a named agent or provider, that recipient is separately responsible for its handling and should provide its own privacy notice. This does not remove our responsibility for the disclosure we make.
3 Information We May Collect
We collect information reasonably necessary for the relevant service. It may include name and contact details; agency, company and licensing details; account and authentication records; listing materials; search criteria, budget, favourites and enquiry history; messages and AI interactions; billing and transaction references for Platform fees; and device, IP address, browser, approximate location and usage information. Exact categories for optional features will be explained at collection. Payment card handling is performed through the payment process identified at checkout; we do not request payment credentials in general chat.We do not require sensitive information, government identifiers or identity documents for ordinary browsing and enquiries. If a particular lawful service requires them, we will first explain the necessity and obtain consent where required. Users must not upload another person's private information without authority. We will assess unsolicited information and destroy or de-identify it where required by law.
4 How Information Is Collected
We ordinarily collect information directly through forms, account use, listing uploads, enquiries, communications and enabled tracking technologies. We may also receive it from an authorised referrer, the agent handling an enquiry, or a provider identified in the relevant collection notice. At or before collection, or as soon as practicable afterwards, we will explain the relevant purpose, usual recipients, consequences of not providing necessary information and how to access this Policy. Where practicable, a person may browse or ask a general question anonymously or using a pseudonym; we may be unable to process an enquiry or paid service without necessary contact or billing information. Before recording or transcribing a call, we will explain the purpose and recipients and obtain the consent required by applicable laws. We will not activate recording merely because a person has accepted the Terms.
5 How Information Is Used
We use information to provide the requested Platform service, manage listings and accounts, route an enquiry to the identified recipient, assist search and matching, respond to support requests, process Platform fees, prevent fraud and maintain security. We may use proportionate analytics to understand and improve the service. Another use or disclosure requires a lawful basis, such as a reasonably expected related purpose, valid consent or a legal requirement.Optional marketing is separate from an enquiry response. We will send commercial electronic messages only with consent required by the Spam Act 2003 (Cth), identify the sender and provide a simple functional unsubscribe facility. We will action unsubscribe requests within 5 working days, without requiring an account login, extra personal information or an unsubscribe fee. Telephone marketing must also meet applicable Do Not Call Register and telemarketing requirements. Refusing marketing does not prevent access to ordinary services, and an agent receiving an enquiry does not automatically obtain consent for unrelated marketing.
6 AI and Automated Processing
AI search and matching may use the criteria a user provides, listing information and, where enabled and disclosed, search and interaction history. Automated systems may order search results, suggest listings, route enquiries and flag suspected misuse. Their inputs and outputs may include personal information. We use these systems only for disclosed and lawful purposes and will take reasonable steps to address inaccurate personal information and inappropriate bias. A user can ask our support contact for an explanation or human review of a Platform decision affecting them. The Platform is not authorised under these documents to decide tenancy or credit eligibility for another party. We do not use identifiable private enquiries, messages, voice records or customer profiles to train or fine-tune a general-purpose AI model as a condition of ordinary service. Any optional training project requires a separate explanation of its purpose, data, recipients, retention, risks and withdrawal limits, and specific voluntary consent and other rights-holder permissions before participation. Refusal does not prevent ordinary service. We will require relevant providers not to use that information for their own model training without a separate lawful arrangement. Properly de-identified information may be used only after assessing re-identification risk and other legal rights. The types of significant decisions made solely by automated systems, the types substantially and directly assisted by those systems, and the kinds of personal information used are: <automated decision description, or a statement that none are made>.
7 Third Party Service Providers
We use service providers for hosting and storage, security, communications, AI functionality, analytics and processing Platform payments. The actual provider names, functions and locations relevant to personal information handling are: <verified provider and processing-location list>. We limit access to information needed for their authorised task and take reasonable steps to impose appropriate confidentiality, security, purpose and retention controls. A provider's separate policy does not replace our obligations. The specific recipient of a property enquiry will be identified before the enquiry is submitted.
8 Disclosure of Information
We may disclose information to the agent or provider the individual selected or authorised, relevant service providers, professional advisers under appropriate duties of confidentiality, and authorities where the disclosure is lawfully required or permitted. A corporate restructure or sale does not provide unrestricted permission to disclose customer data; any due diligence and transfer must be necessary, limited and lawful, with notice or consent where required. We do not sell identifiable enquiry or contact lists for unrelated marketing. Paid matching or referral arrangements, if offered, must be clearly disclosed along with the recipients and purpose before information is shared.
9 Data Retention
We keep personal information only for as long as reasonably needed for the disclosed purpose or a lawful retention requirement. The applicable retention periods or specific criteria are: <verified retention schedule>. We periodically review retained information and take reasonable steps to destroy or de-identify it when no longer needed and retention is not required by law or an applicable exception. Closing an account does not necessarily require immediate deletion of records subject to legal retention, but does end active uses that no longer have a lawful purpose. Access to retained backups will be restricted until scheduled deletion.
10 Data Security
We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Measures are proportionate to the information and risks and include appropriate access restrictions, secure authentication, encryption where appropriate, staff training and oversight of service providers. No system is completely secure. We will investigate suspected breaches, take reasonable containment and remediation steps, and assess and notify eligible data breaches under the Notifiable Data Breaches scheme where it applies. A security incident does not automatically remove our responsibility.
11 Cookies and Tracking Technologies
The Cookie Policy explains tracking and preference controls, including information collected by pixels, tags and server-side events. Where these technologies handle personal information, this Privacy Policy also applies. Disabling browser cookies alone may not stop server-side disclosures. Optional tracking choices must be honoured across the relevant systems.
12 Cross Border Data Transfers
Personal information may be stored in or accessed from Australia and overseas where the providers and recipients actually operate. The countries to which we are likely to disclose personal information, where practicable to specify, are: <verified country list>. Before a disclosure governed by APP 8, we will take reasonable steps to ensure the overseas recipient does not breach the applicable Australian Privacy Principles unless a lawful exception applies. We remain accountable where section 16C of the Privacy Act applies. General acceptance of this Policy is not consent to waive those protections. We do not rely on a blanket overseas-transfer waiver.
13 User Rights
A person may contact the Privacy Contact in the Operator Details to request access to or correction of their personal information, withdraw an optional consent, stop direct marketing or request deletion. We may reasonably verify identity and will respond within a reasonable period, ordinarily within 30 calendar days. Access and correction requests are subject to applicable law; no fee is charged to make a request, and any lawful reasonable access charge will be explained in advance. If we refuse a request, we will give reasons where lawful and explain complaint options. There is no general unconditional right to erasure under the Australian Privacy Principles; we will assess a deletion request against purpose, retention and legal requirements. For privacy complaints, we will acknowledge receipt within 5 business days, investigate and aim to respond within 30 calendar days. If unresolved, the person may complain to the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992, where it has jurisdiction. These timeframes are our service commitments and do not shorten statutory rights.
14 Minors
Accounts and paid services are intended for persons aged 18 or over. This statement does not remove obligations concerning information we actually receive about children or young people. We do not knowingly collect unnecessary information about minors. If it is received, we will assess whether it can lawfully be retained and otherwise remove or de-identify it. Please contact the Privacy Contact about a child's information. Any service specifically directed to children requires separate privacy and safety arrangements.
15 Responsibility for information handling
We remain responsible for our own handling of personal information under applicable law. We do not exclude liability for privacy breaches merely because a hacker, service provider, systems failure or other third party was involved. Clauses 16 and 17 of the Terms and Conditions do not remove statutory privacy rights or remedies.
16 Policy Amendments
We will publish an updated date when this Policy changes and give effective advance notice of a material change in information handling, ordinarily at least 30 days where practicable. Earlier notice may be necessary for legal or urgent security reasons. A new use that requires consent will not begin without that consent. Publication or continued Platform use does not retrospectively authorise a new purpose for previously collected information. Previous versions may be requested from the Privacy Contact.
7. Referral Program Agreement
Last updated: <date>
1 Purpose and Scope
This Agreement applies to people using a referral function expressly offered by Find House. A participant must accept it through a clearly identified agreement step after receiving the Agreement and Terms and Conditions. A referrer is the person making the introduction; a referred person is the person whose information is submitted. The program provides an information and contact function only on the terms below. It does not itself promise a reward or authorise regulated agency activity.
2 Platform Status
Find House provides enquiry submission, information transmission and matching tools. It does not under this Agreement represent a buyer, seller, landlord or tenant, negotiate a transaction, hold client money or administer a reward payment. Actual activities determine any licensing or AML/CTF obligations. We remain responsible for our own services and any representations about the program. A service cannot avoid regulation merely by being called a referral or technical service.
3 Operation of the Referral Program
A participant may submit a referral through an offered channel only with the referred person's authority. Before submission, the function must identify the proposed recipient or recipient group, the purpose, any applicable Platform fee and any material commercial relationship. Where recipients are not yet identified, the referred person's confirmation must be obtained before disclosure to them. A referral is a request for contact, not authority to negotiate or commit anyone to a transaction.
4 No Participation in Benefit Arrangements
No reward is created by this Agreement. A separate lawful arrangement between identified parties may provide a referral benefit, but it must be documented before the participant relies on it. It must identify the payer and recipient, amount or calculation, eligibility, qualifying event, payment timing, tax treatment, cancellation rules and dispute process. It must not involve unlicensed activity, a prohibited commission share, a secret commission or a conflict that applicable law prohibits. Disclosing a benefit does not by itself make a prohibited arrangement lawful. Find House does not set or administer such a private reward under this Agreement; if it offers its own reward or commission model, separate compliant terms are required before launch.
5 The Platform Is Not the Payer
An identified third-party payer is responsible for its own promised reward. Find House does not guarantee that obligation merely by transmitting referral information. This does not excuse Find House from an obligation it expressly undertakes or responsibility for its own misleading statements or conduct. No participant may represent that a reward is guaranteed by Find House without its lawful written authority.
6 No Guarantee of Rewards
Submitting a referral does not itself guarantee a transaction or reward. A participant's entitlement under a valid separate reward agreement is determined by that agreement and applicable law, and is not removed by this clause. Promotional statements must accurately identify who offers a reward and all material qualifying conditions.
7 No Guarantee of Transaction
We do not guarantee a particular response rate, enquiry volume, viewing, sale, lease or transaction speed. We must still supply any agreed paid referral service as described and meet applicable consumer guarantees. Participants remain responsible for their own transaction decisions; liability for loss depends on applicable law and each party's conduct.
8 Truthfulness of Referral Information
The referrer must take reasonable steps to ensure that submitted information is accurate, current and lawfully provided. A referrer must not invent an identity or enquiry, impersonate another person, submit information without authority, or use the program for spam or harassment. The referrer must correct known errors promptly. We may investigate a credible report and take proportionate action under the Terms and Conditions.
9 Personal Data Authorisation
Before submitting personal information, the referrer must obtain the referred person's specific permission to share the stated details with Find House for the stated enquiry and with the identified intended recipient. The referrer must provide the collection notice and keep appropriate evidence of permission. We will also take reasonable steps to notify the referred person of the source, purpose and recipients and, where necessary, obtain direct confirmation before onward disclosure. An initial confirmation must not be used to send unsolicited marketing. Neither a referrer's assurance nor this Agreement removes Find House's own privacy obligations. Separate consent is required where law requires it for marketing or another optional use.
10 Enquiry allocation and privacy
No participant owns a person or their personal information. Allocation of an enquiry must respect the individual's directions, the disclosed matching process and any agreed paid exclusivity. Personal information must not be reallocated to unrelated agents merely because a lead is described as part of a Platform database. The privacy and allocation safeguards in clause 9 of the Agent Listing Agreement apply to participating agents.
11 Platform’s Management Rights
Program changes and account restrictions are subject to clauses 4 and 21 of the Terms and Conditions. We will give required notice, act proportionately and preserve accrued rights, including rights under a separate valid reward agreement. Suspending future referrals does not retrospectively remove an entitlement already earned.
12 Legal and Compliance Responsibility
Each participant must comply with the licensing, agency, disclosure, anti-bribery, consumer, privacy and tax requirements applying to its own activities and location. A referral must not involve regulated negotiations, transaction representation or another licensed function without the necessary authority. Any fee or benefit must be assessed against the rules of each relevant State or Territory before it is offered or accepted. Find House is also responsible for requirements applying to its own role. This Agreement provides no approval or assurance that a particular reward or commission arrangement is lawful.Participants must not induce a consumer to acquire goods or services by promising a rebate, commission or other benefit for supplying prospective customers or helping further sales, where receiving that benefit is contingent on an event occurring after the consumer enters the contract, in circumstances prohibited by section 49 of the Australian Consumer Law. No pyramid selling or unlawful referral selling is permitted.
13 Anti Money Laundering and Unlawful Use
No participant may use the program for money laundering, terrorism financing, sanctions evasion, fraud or sham transactions. Each party must assess and perform its own AML/CTF obligations where designated services are provided. We may take proportionate protective action and lawfully preserve or disclose records; we may withhold notice where required by law. A referral arrangement does not permit Find House to receive purchase deposits, rent, bonds or other client money.
14 Referral Dispute Resolution
A dispute about a private reward should first be raised with its identified payer and other contracting party. Find House does not adjudicate that private agreement, but will consider complaints about its own service and provide reasonable assistance and relevant records where lawful and available. Nothing prevents a lawful request, a regulatory complaint, proceedings or a right of access to personal information.
15 Limitation of Liability
Clauses 16 and 17 of the Terms and Conditions govern Find House's liability. The fact that a claim concerns a referral or reward does not exclude liability for our own breach, negligence or misleading conduct.
16 Limited business indemnity
For a participant acting in business, only the limited indemnity in clause 18 of the Terms and Conditions applies. No indemnity is imposed on a participant acting solely for personal, domestic or household purposes. A person is not responsible for unrelated conduct of another participant or for Find House's own contribution to loss.
17 Complaints governing law and disputes
Clause 19 of the Terms and Conditions applies to disputes involving Find House, including Australian governing law and access to competent Australian courts and tribunals. No compulsory Hong Kong arbitration applies. A private reward agreement has its own lawful dispute process and cannot remove a person's mandatory rights against Find House.
18 Representative proceedings
Participants retain any right to bring or join representative proceedings, make regulatory complaints and exercise non-excludable rights. No class action waiver applies.
19 Final Statement
The program connects people for the specific contact purpose disclosed. Participants must understand who supplies the Platform service, who receives the information and whether an identified third party has made a separate lawful reward promise. Find House remains responsible for its own commitments and legal obligations. A change to a paid introduction, commission or payment model requires assessment of the actual activities and appropriate terms before it is implemented.
